Scope of these terms

These terms govern access to and use of this website (codivio.studio). They apply to all visitors, whether acting as consumers (B2C) or as businesses (B2B). Service contracts for specific projects are governed by separate written agreements signed by both parties, which take precedence over these terms in matters of scope, deliverables and payment.

All content on this site — including text, graphics, illustrations, code and pricing information — is provided for informational purposes only. It does not constitute a binding commercial offer. Prices and timelines shown are indicative starting points; every engagement is confirmed by a separate written quote.

Intellectual property

All content on this site belongs to Codivio Studio unless otherwise stated. You may not reproduce, distribute or commercially exploit any part of it without our prior written consent. Brief quotations with attribution and a link to the source are permitted.

Acceptable use

You agree to use this site for lawful purposes only. You may not attempt to access it by automated means (scraping, crawling) without our consent, introduce malicious code, or use it in any way that could harm Codivio Studio or other users.

This site is provided 'as is'. We take care to keep information accurate but make no warranty of completeness or fitness for a particular purpose. We are not liable for any direct or indirect loss arising from use of the site or reliance on its content. We are not responsible for the content of third-party websites linked from this site.

Privacy and cookies

The processing of personal data collected through this site is governed by our Privacy Policy, available at codivio.studio/privacy. We use only essential technical cookies. No profiling or advertising cookies are set without your explicit consent.

Right of withdrawal (consumers)

If you are a consumer (a natural person acting outside any trade or profession) and you enter into a distance contract for our services, you have the right to withdraw within 14 calendar days without giving any reason, in accordance with EU Directive 2011/83/EU and Italian Legislative Decree 206/2005. If you expressly request that work begins before the withdrawal period expires and acknowledge that you will lose this right upon full performance of the service, that right will be waived upon commencement of work. This clause applies only to B2C contracts; it does not affect B2B engagements.

Alternative dispute resolution

In the event of a dispute arising from a B2C contract, you may use the European Online Dispute Resolution (ODR) platform operated by the European Commission at: https://ec.europa.eu/consumers/odr/. We are not obliged to participate in ODR proceedings but will consider all reasonable requests for out-of-court resolution.

Force majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, power outages, internet disruptions or pandemic-related restrictions, provided the affected party notifies the other promptly and takes reasonable steps to mitigate the impact.

Severability

If any provision of these terms is found by a competent court to be invalid, unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.

Changes to these terms

We may update these terms at any time. The current version is always available at codivio.studio/terms with the date of last update. Continued use of the site after an update constitutes acceptance of the revised terms.

Governing law

These terms are governed by Italian law. For B2C consumers domiciled in another EU member state, the mandatory consumer protection provisions of that member state also apply. Any dispute not resolved amicably falls under the exclusive jurisdiction of the courts of Bergamo, Italy, except where mandatory law provides otherwise for consumers.
